Do not skimp on health: advice from the insurer

In 2008 entered into force the Law "On mandatory insurance of civil liability for causing harm to life and health of the worker at execution of labour (service) duties", according to which all employers — both legal and natural persons who are entrepreneurs without education of the legal entity, are obliged to insure their liability to officers of the employer in labour relations on the basis of an employment contract.

After approval of the tariffs by the government of the Kyrgyz Republic in 2010 according to this law, responsible employers are actively using this type of insurance, but voluntarily, because until now there are no penalties against employers that ignore the law.

First and foremost, this type of insurance is aimed at protecting the interests of the employee, if he is injured in the line of duty through the fault of the employer and the latter is not possible to pay compensation under the Labor code. Passing its liability insurers, employers liberate yourself from unexpected expenses, and the affected employees can count on timely payment from the insurance company.

According to the Labour code of the Kyrgyz Republic for each full-time employee — from top management to the driver or guard — the employer is liable to 20 of the annual payroll. Upon receipt by the employee of disability of the 3rd group through the fault of the employer the latter is obliged to pay compensation to the affected employee in the amount of three annual salaries; when receiving disability 2 group five annual salaries; when you receive a disability of the 1st group — 10 annual wages. And in that case, if the employee died in the line of duty, the employer is obliged to pay compensation to the heirs in the amount of twenty annual wages of the deceased.

And all of this responsibility to staff employers can pass on to the insurance company at very low rates compared to voluntary types of insurance.

The insurance is valid in the performance of official duties by employees on the territory of the Kyrgyz Republic, as well as on the way to and from work, 24 hours a day abroad worldwide at the check-out employee on a business trip (on business) and back.

Tariffs are divided according to classes of professional risk:

administrative staff — part of the staff that manages the organization, or acts as the technical management, i.e. leadership, secretaries, office managers, accountants. The rate for this class of professional risk — 0.03 percent of the annual wage Fund;

production staff are employees directly involved in manufacturing is responsible for the basic direction of the organization. Rates on this class of professional risk is different, depending on the complexity of the production and working conditions;

For example, the restaurant owner decided to transfer the responsibility to its employees insurance company to 10 GFOT. In this case, the calculation will be made in the following way: the received insurance award in the amount of 11 400 kgs multiplied by a correction factor of 7.60, it turns out the total insurance premium 86 640 soms. The responsibility will be borne by the insurance company under the contract will amount to 100 million soms.
