Mandatory insurance of civil liability of organizations, operating dangerous production objects

February 19, 2009 a Law of the Kyrgyz Republic No. 202 as of 15.08.208 “On mandatory insurance of civil liability of organizations, operating dangerous production objects” has entered into force.

Who must conclude an agreement of mandatory insurance?

The agreement of mandatory insurance shall be concluded by individual persons and / or legal entities, owing dangerous object on the right of ownership or housekeeping or operating control, or on the other legal basis and executing activities:

1. with conduction of mountain works, works on mineral processing, as well as works in underground conditions;
2. with getting of smelts of ferrous and nonferrous metals, rocks and alloys on the basis of these smelts;
3. with use of equipment, working under pressure more than 0,07 MPa or at a water heating temperature of 115 centigrade degrees and higher;
4. stationary installed and movable lifting mechanisms, escalator, cable haulage, funiculars;
5. with getting, formation, processing, use, storage, transportation, destruction, sale of inflammable, combustible, oxidizing, explosive, toxic and radioactive substances (order of attribution to dangerous production objects, where indicated harmful and dangerous substances are used, is established by the Government of the Kyrgyz Republic).
6. with implementation of burials of mining and smelting production waste, containing substances, dangerous for human life and environment.

Insurance agreement is concluded for each dangerous production object separately.

1. Types of dangerous production objects, where: Minimal aggregate liability limit, KGS
2. mining operations, works on minerals fortification, as well as works in underground conditions are conducted 10 000 000
3. melts of ferrous, nonferrous metals, rocks and alloys on the basis of these smelts are received 10 000 000
4. equipment, working under pressure more than 0,07 MPa or at a water heating temperature of 115 centigrade degrees and higher is used 7 000 000
5. stationary installed and movable lifting mechanisms, escalator, cable haulage, funiculars are used 1 000 000
6. inflammable, combustible, oxidizing, explosive, toxic and radioactive substances are formatted, processed, used, stored, transported, destructed, sold, (order of attribution to dangerous production objects, where indicated harmful and dangerous substances are used is established by the Government of the Kyrgyz Republic). 15 000 000
7. burials of mining and smelting production waste, containing substances, dangerous for human life and environment are conducted. 10 000 000

Liability limit for the risk of injury of harm to life and health of third parties comprises 300 000 KGS per one person.

Insurance rates:

Basic insurance tariff is equal to 0,144 %.

In case of territory location of a dangerous production object close to inhabited localities, native zone, rivers, lakes, agricultural lands guarded by the state, an increasing coefficient of 1.5 is applied to the basic tariff, except for the objects, where stationary installed and movable lifting mechanisms, escalator, cable haulage, funiculars are used.

Period of the agreement.

Insurance agreement is concluded in written by means of insurance policy issue for the term not more than twelve months.
